Terms, Conditions and Limitations

This Warranty excludes any leaks caused by:

Fire, lightning, peak gust wind speeds exceeding 50 mph measured at eave level, hailstorm, Flood, earthquake, or other extraordinary weather phenomena.

This Warranty further excludes leaks or damage caused by:

• Structural settlement, failure, movement, cracking or excess deflection of the roof deck or exterior walls;

• Defects or failure the pre-existing substrate over which the roofing system is applied;

• Any faulty condition causing movement of parapet walls, copings, chimneys, skylights, ventilation supports or other parts of the building;

• Vapor condensation beneath the roof covering;

• Penetration of pitch boxes, erosion, cracking and porosity of mortar and brick

• Dry rot;

• Penetrations of the roof from underneath by pre-existing rising fasteners of any type;

• Insufficient drainage;

• Clogging of roof drains and/or gutters, inadequate pitch or other conditions beyond our control which cause ponding or standing water;

• Damage by termites or other insects, rodents or other animals;

• Harmful chemicals, oils, acids and the like that come in contact with the roofing system and cause a leak or otherwise damage said system;

• Any acts or omissions that compromise the watertight condition of the roof system.

If the roof fails to maintain a watertight condition because of damage due to any of the foregoing, this Warranty shall immediately become null and void unless we are hired, at a reasonable expense, to repair said damage.
